Welcome to Maddietanks. This website is operated by PureFit Wellness Corp, doing business as Maddietanks, and "we", "us" and "our" refer to that company. By accessing our website, placing an order, or using our services, you agree to these Terms of Service ("Terms"). Please read them carefully, as they form a binding agreement between you and Maddietanks.

1. General conditions

By placing an order, you confirm that you are at least 18 years old, that the information you provide is accurate and complete, and that you are an authorized user of the payment method used. We reserve the right to refuse or cancel any order or to refuse service where we reasonably suspect fraud, unauthorized payment, or a breach of these Terms.

2. Products and pricing

We aim to describe and price every product accurately. Prices, descriptions, and availability may change at any time without notice. In the event of an obvious pricing or description error, we reserve the right to cancel the affected order and issue a full refund, even after an order confirmation has been sent.

3. Payments and authorization

All payments are processed through trusted, secure providers, and we do not store your full payment details. By submitting an order and providing a payment method, you authorize us to charge the full order amount, including any applicable shipping and taxes, to that payment method. You confirm that you are the account holder or have explicit permission to use it. Submitting an order constitutes a firm commitment to purchase.

4. Order acceptance and cancellation

Your order is an offer to buy, and a contract is formed once we send your dispatch confirmation. You can cancel free of charge at any time before your order ships, as set out in our Terms of Sale, which forms part of these Terms. Once an order has shipped it can no longer be canceled or changed, but our Refund Policy still applies. Customers in the United Kingdom also have a statutory right to cancel within 14 days of delivery.

5. Shipping, delivery, and risk

Delivery timeframes are estimates and are not guaranteed. You are responsible for entering a correct and complete shipping address at checkout. Responsibility for the order passes to you once it is delivered to the address you provided. If tracking shows your order as delivered but you have not received it, follow the steps in our Shipping Policy and we will open a carrier claim with you. 

6. Returns and refunds

Refunds, replacements and the 90-Day Perfect Fit Guarantee are handled in accordance with our Refund Policy, which forms part of these Terms. In most cases you do not need to send anything back. Where we do ask for an item to be returned, we provide a prepaid label first. Refunds are issued to the original payment method only.

7. Disputes and chargebacks

If you have any concern about an order, a charge, or a delivery, please contact us first at support@maddietanks.com so we can resolve it directly. We reply within 1–2 business days and resolve most issues in a single email. By agreeing to these Terms, you agree to raise any billing concern with us before initiating a chargeback or payment dispute. Initiating a chargeback for an order that was delivered as described, or that falls outside the terms of our published policies, may be treated as a breach of these Terms, and we reserve the right to submit our records, including order, delivery, tracking, and communication history, in response.

8. Limitation of liability

To the fullest extent permitted by law, Maddietanks is not liable for any indirect, incidental, or consequential loss arising from the use of our products or website. Our total liability in connection with any order is limited to the amount you paid for that order. 

9. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Nothing in these Terms removes any right you have under the consumer protection law of the country you live in, and you may always bring a claim in the courts of that country. Customers in the United Kingdom keep their rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013; customers in New Zealand keep their rights under the Consumer Guarantees Act 1993. Any dispute will be handled respectfully and in the spirit of finding the best resolution for you.

10. Amendments

We may update these terms from time to time. Changes take effect as soon as they are posted, and the "last updated" date above will reflect the most recent version. Your continued use of the site after changes are posted constitutes acceptance of the updated terms.
